Any advice apreciated

A friend is going through a dreadful divorce and is emmergrating once all is settled. She has two dogs who her partner wants to keep. She wants them to go somewhere else as she doesnt think he will look after them. They are registered in her name with KC and vets etc. Does she have the right then to remove them without his permission. I really feel for her because I know he will not care for them that well. They will be crated for up to 12 hours with a little walk after that then he will be back out again its hardly a life is it? What are your opinions. She wants to just take them on that last day to the new homes she has organized but can she get into trouble if she does this?

It seems a bit unfair on the person she is going to rehome them too if she leaves the country and her ex decided to challenge her decision.....I think she needs to sort it out before she goes really  :-\ Why can't she take them with her?

Civil courts will make ruling in cases like this; the fact that the dogs are KC registered in her name is not enough - if he can prove that he has provided for their upkeep, and can offer them a good home.  It always seems to be pets and children that suffer...... :'(

I know I totally agree! I also have mentioned the possibility he may go after them. Its such an awful situation. I have to be careful what I type as you never know who may be browsing but there is no way she can take them due to where she will be living. I would love to help but I cant cope with the breed involved so I cant unfortunately. Again this is the other problem the breed of dog, nothing can be straight forward can it!
I guess he has paid for half of their upkeep thats about it oh and the odd walk.

I assume that the breeder isn't willing to take them back?

If they are rescue dogs, then your friend probably signed a contract to say they should go back to the rescue - how about a breed rescue?

No they are not rescue dogs and no the breeder doesnt want them back! I said about the breed rescue the thing is she has found tham loving caring homes and I think thats what she would prefer rather than  taking them to a rescue place. I think its the whole caging she worries about. She keeps asking her ex to change his mind, I think he is doing it for the power he can see it tearing her apart, she loves them like children but she cannot take them with her and one of the dogs I think beacause of the breed isnt meant to fly long haul im not sure if that is true. However it makes no difference because of where she is going she cannot take them.  :'(
