Unfortunalty, if the dog had seriously bitten, it would be pts anyway 
Perhaps the rescue centre should have sent him to a quieter household

My neighbour was badly bitten on her leg by an alsation dog in the street. She reported it to the police and the owners were given a warning, the second attack will result in him being PTS even if the Alsations owners disagree.

If the dog can be proved to have been "dangerously out of control in a public place" then the DDA applies and a destruction order can be issued by a court. Otherwise, the law is still quite vague about biting dogs; if you are bitten by a dog in its own home/garden for instance, then you can file a civil action (which often include a request for the dog to be PTS), but the law doesn't really cover these types of cases
A lot of rescue organisations will PTS a dog that has bitten to avoid the risk civil legal action against them if the dog is rehomed and bites again
There are also rescue centres which will never PTS a dog, no matter how severe their behavioural problems. IMO, there needs to be a happy medium that takes individual circumstances into account
